LEMON LAWS: SPECIAL WARRANTY LAWS FOR CARS AND TRUCKS

Even though the powerful laws described above apply to ALL consumer products with a warranty, when most consumers hear the word “warranty” they think of cars and trucks.  In addition to the laws that apply to all products, Cars and trucks even have a special law in each state that applies only to automobiles and is commonly referred to often as the “lemon law.”  The “lemon law” differs from the other warranty laws in that it provides for a “buyback” in some cases. 

A “buyback” means that the manufacturer pays most of the money back that the consumer has paid for the vehicle, and the consumer returns the vehicle to the manufacturer.   Lemon laws, like the other warranty laws, also have an attorney fees provision and allow attorneys to help consumers at no charge, with the expectation that the manufacturer will pay their attorney’s fees if successful.  What makes a car a “lemon” under this law is similar to all warranty laws.
